This privacy policy (the “Privacy Policy” or “Policy”) is applicable to any websites and/or goods or services offered by Mile High Run Club LLC and its current and future affiliates, subsidiaries, successors, assigns, (collectively, (“Mile High”, “We” or “Us”), including, but not limited to, www.milehighrunclub.com, and any mobile application or other online communications, features, services and/or programs offered by Us (collectively, the “Site”). Your use of the Site is also governed by, and this Privacy Policy is made a part of, the Terms of Service. 

We understand the importance of privacy and we want you to be as comfortable as possible visiting our Site and using our services. This Privacy Policy provides an overview of what information We may collect from you through the Site, and how We may use it, as well as certain of the steps We take to safeguard personal information. Please review this Privacy Policy before using the Site of submitting any personal information. 

By using the Site, including, but not limited to purchasing classes or registering for any other Services (as defined in the Terms of Service), you are accepting the practices described in this Privacy Policy. Our practices may change, but any changes will be posted and changes will only apply to activities and information after such time. You are encouraged to review the Privacy Policy whenever you visit the site to make sure that you understand how any personal information you provide will be used. Note: the privacy practices set forth in this Privacy Policy are for this Site only. If you link to other websites, please review the privacy policies posted at those sites.

INFORMATION WE COLLECT

We collect both personally identifiable information and non-personally identifiable information. 

Personally Identifiable Information. Such personal information may be collected through and include the types of information you specifically provide to Us through registration of an Account (as defined in the Terms of Service), purchasing classes or other Services through the Site or Mile High mobile application, or other information you voluntarily provide, and may include contact information, including your name, mailing address, telephone number, email address, and/or other information specific to you; and credit card and other payment information.  You may choose not to provide any personally identifiable information, however, your experience on the Site may be diminished and some features or access to Services through the Site may not be available or may not work as intended.

Credit Card Information. The online purchasing system on the Site is designed to protect the privacy of your credit card information, name, address, email and any other information you provide us.  We offer the industry standard security measures available by utilizing a Secure Socket Layer (“SSL”) connection. All credit card information that you provide in connection with making a purchase through the Site is transmitted using 128-bit encryption technology and processed by a trusted third party merchant processor. If at any time you would like to make a purchase, but do not want to provide your credit card information online, you may contact a sales representative via telephone at 212 466-6472. 

Non-Personally Identifiable Information.  This information does not identify you personally. Our web server automatically collects some information about you when you request pages from our server, including your IP address. Your IP address is a number that is used by computers connected to the Internet to identify your computer so that data (such as the web pages you request) can be sent to you. We aggregate this data with data on the pages visited by other users to track overall user traffic patterns. We use this information to improve the Site by making it more responsive to the needs and preferences of our users.

Use of Cookies and Web Beacons.  We use cookies and web beacons to collect non-personally identifiable information from the Site. A cookie is an entry in a text file or folder on your hard drive. Cookies cannot read data from your hard drive.  A web beacon is a file located on the Site that tracks your viewing of pages within the Site. This non-personally identifiable information which is gathered in our log files is not linked to any personally identifiable information and is utilized only for aggregate statistics.  We can only read cookies from our own Site. 

PURPOSE AND USE OF INFORMATION COLLECTED

We use information supplied by you to provide products and services to you. We also may receive information about you in connection with a request from you and/or providing support to you. We may now or in the future collect names and/or email addresses for the purpose of maintaining a mailing list regarding our services, products and other services and products in which we believe you would have an interest. We do not use your email address or other personally identifiable information collected through the Site for commercial or marketing purposes without your consent or except as part of a program or feature for which you will have the ability to opt-in or opt-out. Non-identifiable information about you may be used for the purpose of improving the features and functionality of the Site.

We may share non-personally identifiable information (such as anonymous user usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third parties to demonstrate the usage patterns for Mile High’s advertisements, content, functionality promotions and/or services on the Site.

We also reserve the right to disclose personally identifiable information and/or non-personally-identifiable information in connection with the enforcement of our Terms of Service, take precautions against liability, to investigate and defend against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Site, and to protect the rights, property, or personal safety of Mile High, its clients, employees, contractors, owners, managers, agents, or others.

We reserve the right to transfer your personally identifiable information, as well as any other information, in connection with the sale or other disposition of all or part of the Mile High’s business and/or assets. We also cannot make any representations regarding the use or transfer of your personally identifiable information or other information that we may have in the event of our bankruptcy, reorganization, insolvency, receivership or an assignment for the benefit of creditors. Furthermore, we cannot and will not be responsible for any breach of security by any third parties or for any actions of any third parties (including other users of the Site) that receive any of the information that is disclosed to us. The Site may also link to other websites and the Site may contain advertisements of third parties. We are not and cannot be responsible for the privacy policies of those websites of third parties or how they treat information about their users – accordingly please review the policies of such third-parties when using their digital platforms.

USER ACCOUNT, PASSWORD, AND SECURITY

For certain features available through the Site, we may require the use of encryption technologies provided for your protection and/or your purchase of items through our web store. We use reasonable precautions to protect the privacy of your personally identifiable information, your user identification and passwords for any Accounts.  You, however, are ultimately responsible for protecting any user identification, password and Account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies. You agree to: (a) immediately notify Mile High of any unauthorized use of your user identification, password and/or Account, and/or any other breach of security; and (b) ensure that you exit from your Account at the end of each session. While we may provide certain encryption technologies and use other reasonable precautions to protect your confidential information and provide suitable security, we do not and cannot guarantee or warrant that information transmitted through the Internet is secure, or that such transmissions are free from delay, interruption, interception or error.  

INFORMATION FROM CHILDREN

The Site is not intended or designed to attract children under the age of thirteen (13). We do not collect personally identifiable data from any person that we know to be under the age of thirteen (13). You affirm that you are either more than eighteen (18) years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy. In any case, you affirm that you are over the age of thirteen (13), as THE WEBSITE IS NOT INTENDED FOR CHILDREN UNDER THIRTEEN (13) THAT ARE UNACCOMPANIED BY HIS OR HER PARENT OR LEGAL GUARDIAN.

Parents should be aware that this Policy will govern our use of personal data, but also that information that is voluntarily given by children – or others – in email exchanges, bulletin boards or the like may be used by other parties to generate unsolicited communications.

The Site may contain various links to other websites, including links to various third party service providers. Mile High is not and cannot be responsible for the privacy practices or the content of any of those other websites. We do not share any of the personal information that you provide to us with any of the websites to which the Site links, although we may share aggregate, non-personally identifiable data with those other websites. Please check with those websites in order to determine their privacy policies and your rights under them.

INFORMATION SECURITY

We make every effort to ensure that information collected through the Site is not lost, misused, or altered inappropriately by administering security measures. However, all information transferred over the Internet can potentially be accessed by unauthorized parties; therefore, Mile High cannot guarantee the security of your data transmitted to the Site.

CHOICES WITH YOUR PERSONAL INFORMATION; OPT-OUT

You are under no obligation to submit personally identifiable information to Mile High, although you may not be able to access certain of Mile High’s services. 

You may opt out of any disclosure or use of your personally identifiable information for purposes that are incompatible with the purpose(s) for which it was originally collected or for which you subsequently gave authorization by following the instructions at the end of this Privacy Policy, or by following the procedures set forth in an electronic communication from us, if applicable, or contacting us at info@milehighrunclub.com to request the deletion of certain personally identifiable information. There are some uses from which you cannot opt-out, including, but not limited to, our use of information about you in connection with providing support that you request for the Site.

EXCLUSIONS

This Privacy Policy does not apply to any personal identifiable information of you collected by Mile High other than personal information collected through the Site. This Privacy Policy shall not apply to any unsolicited information you provide to Mile High through this Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Site (collectively, “Public Areas”), any ideas for new products or modifications to existing products, and other unsolicited submissions provided to Mile High, including, but not limited to, photos and content (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and We shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

YOUR CALIFORNIA PRIVACY RIGHTS

If You are a California resident, you have the right to receive: a) information identifying any third party company(ies) to whom We may have disclosed, within the previous calendar year, Your personally identifiable information for that company’s direct marketing purposes; and b) a description of the categories of personally identifiable information disclosed.
